This perception of second rate status of Fathers is promoted through modern television programs, advertising and even the educational system. Individual rights are promoted at the expense of family unity. And, the Father takes the hardest hit in the breakup of the family unit.
The custody rights of fathers have further deteriorated due to an unlikely source -abortion, or more exactly, the ongoing legal debate over abortion rights. In order to support abortion rights arguments, proponents must assert that the developing fetus is entirely the domain of the woman. Therefore no one else, including the father, has any say in the decisions made concerning that fetus. It is difficult then, to say that the exclusive domain ends at the point of birth.
The good news is that in recent years fathers have begun to fight back. A smattering of recent court rulings are turning against the generations-old thinking that puts the burden on the father. Organizations and publications are springing up to support the rights of fathers. More and more legal resources are being devoted to helping fathers keep custody of their children after divorce. Even traditional family advocates which have in the past penalized fathers are beginning to become gender blind in their efforts to provide the best care for the children of divorce, increasingly pushing for joint custody.
Fathers must educate themselves so they know their rights and can substantiate their claims by producing court cases that have previously been adjudicated in favor of the Father. Fathers may lose issues they should rightfully have won because they rely on their attorney to be informed and fight for them, which is often not the case.
There are many legal proceedings supporting Fathers custody rights and any Father fighting for custody needs to be fully aware all court actions that favor Fathers. Attorneys are often not fully aware of the most recent or long time standing cases that set the stage for Fathers winning custody and it may be up to the Father to provide this detail to their attorney in order to have the best possibility of winning custody.
Fathers should never enter a court proceeding until they have educated themselves fully about the case law favoring Fathers winning custody whether they are represented by an attorney or not.
